We worked on this project for two years — together with lawyers, doctors, scientists, politicians, NGOs and government agencies. This page briefly and simply describes how we propose to regulate the cultivation and use of cannabis for industrial, scientific and medical purposes.
Medicinal cannabis under the Project is cannabis with a THC (tetrahydrocannabinol) content of more than 1%. The maximum permissible content of THC, as well as the indicators of CBD (cannabidiol) should be set by the Cabinet of Ministers of Ukraine at the request of The State Service of Ukraine on Medicines and Drugs Control within 3 months from the date of adoption of the law.
WHAT CANNABIS ALLOWED TO PRODUCE?
Regulator — Ministry of Health of Ukraine. The implementation of state policy in this area will be entrusted to The State Service of Ukraine on Medicines and Drugs Control. Certain powers to control production and circulation are entrusted to the National Police of Ukraine.
WHO WILL REGULATE PRODUCTION AND TURNOVER?
The project does not resolve the issue of taxation. Current legislation does not include cannabis in agricultural products, i.e. does NOT apply the so-called simplified taxation system to cannabis.
WHAT ABOUT TAXATION?
Ліцензія. Стандартна ліцензія діє 5 років, її видає Держлікслужба. Умови ліцензування має встановити Кабінет міністрів України протягом 3 місяців з дня прийняття закону. Теплиці. Проєкт передбачає вирощування виключно в закритому ґрунті. Квоти. Кабінет міністрів щороку визначає квоти на виробництво і зберігання лікарських конопель. Лабораторний контроль. У виробника має бути своя лабораторія або договір з лабораторією для контролю показників ТГК/КБД. Персонал. Працювати з лікарськими коноплями можуть виключо психічно здорові люди без судимостей, без алкогольної та наркотичної залежності. Дозвіл нацполіції на використання приміщень, де відбувається взаємодія з коноплями, наявність цілодобової охорони та пропускного режиму Маркування кожної партії та одиниці фасованої продукції Реєстрація усіх дій з переміщення лікарських конопель у публічному реєстрі наркотичних засобів
WHAT ARE THE REQUIREMENTS FOR THE MANUFACTURER?
THC drugs are manufactured under license, prescribed and sold only on prescription. Drugs with CBD are regulated as dietary supplements - i.e. freely produced and sold.
